1.1Agreement to Terms

By accessing or using BrevityU, you agree to:

• These Terms of Service
• Our Privacy Policy (incorporated by reference)
• Our Community Guidelines
• Any additional terms applicable to specific features

1.2Binding Agreement

These Terms constitute a legally binding agreement between you and Brevity Networks, LLC. If you are using BrevityU on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1.3Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email, in-app notification, or prominent notice on the platform. Continued use after changes take effect constitutes acceptance of the modified Terms.

2.1Age Requirement

Technical Age Verification (as of March 2026): BrevityU technically enforces this requirement at registration. All new users must provide their full date of birth through a mandatory age gate. The submitted date of birth is validated on both the client and our server; registrations from users under 16 are blocked and no account is created. This applies to all registration paths including email registration and Google Sign-Up.

2.2Parental Consent

• If you are between 16 and 18 years old, you should obtain parental or guardian consent before using BrevityU
• Your parent or guardian may contact us to review or terminate your account
• You agree to use the platform responsibly and in accordance with these Terms

2.3Geographic Restrictions

BrevityU is currently available in: United States (primary market), European Union (expanding within 2–4 months), Global (expanding within 4–6 months).

We reserve the right to restrict access based on geographic location, legal requirements, or business decisions.

2.4Prohibited Users

• You are under 16 years of age
• You have been previously banned from the platform
• You are prohibited by law from using the platform
• You are located in a country subject to U.S. embargo or sanctions

3.1Account Creation

To use certain features of BrevityU, you must create an account by providing:

• Full name
• Unique username
• Valid email address
• Secure password
• Date of birth (for age verification)

3.2Account Information Accuracy

• Provide accurate, current, and complete information
• Update your information promptly when it changes
• Not impersonate any person or entity
• Not use a username that is offensive, misleading, or infringes on others' rights

3.3Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Logging out of your account on shared or public devices

3.4One Account Per Person

• You may only create and maintain one account
• Creating multiple accounts to evade restrictions is prohibited
• Selling, transferring, or sharing accounts is prohibited

4.1Acceptable Use

You agree to use BrevityU only for lawful purposes and in accordance with these Terms. You will respect other users and the community, comply with all applicable laws, and use the platform for educational and informational purposes.

4.2Prohibited Content

You may NOT post, upload, or share content that:

Illegal Content

• Violates any local, state, national, or international law
• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code

Harmful Content

• Promotes violence, terrorism, or dangerous activities
• Contains graphic violence or gore
• Depicts or promotes self-harm or suicide
• Exploits or endangers minors in any way

Hateful Content

• Promotes hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Contains hate speech or symbols
• Harasses, bullies, or threatens others

Sexual Content

• Contains nudity or sexually explicit material
• Promotes sexual services or exploitation
• Contains sexual content involving minors (strictly prohibited)

Misleading Content

• Contains false or misleading information
• Impersonates others or misrepresents affiliations
• Promotes scams, fraud, or deceptive practices

4.3Prohibited Activities

You may NOT:

Platform Abuse

• Attempt to gain unauthorized access to the platform or other accounts
• Interfere with or disrupt the platform's operation
• Reverse engineer, decompile, or disassemble the platform
• Use automated tools (bots, scrapers) without permission

Academic Misconduct

• Share exam answers or promote cheating
• Plagiarize or misrepresent academic work
• Violate academic integrity policies

Legal Violations

• Engage in copyright infringement
• Violate export control laws
• Facilitate illegal activities

5.1Your Content

Ownership

You retain all ownership rights to the content you create and upload ("Your Content"). You are solely responsible for Your Content and its consequences.

License to BrevityU

By uploading content to BrevityU, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, display, modify, adapt, and create derivative works of Your Content for the purpose of operating and improving the platform. This license survives termination of your account for content that has been shared or distributed.

Content Removal

• You can delete Your Content at any time
• Deletion may not be immediate due to technical limitations
• Cached or backup copies may persist for a limited time

5.2Platform Content

All platform content, features, and functionality (excluding Your Content) are owned by Brevity Networks, LLC and protected by copyright, trademark, patent, and trade secret laws.

• You may NOT copy, modify, distribute, or create derivative works
• You may NOT use our trademarks without permission
• You may NOT remove copyright or proprietary notices

5.3Copyright Infringement (DMCA)

To report copyright infringement, email admin@brevityu.com with subject "DMCA Takedown Notice" and include:

1. Your contact information (name, address, email, phone)
2. Description of the copyrighted work
3. Location of infringing material on BrevityU (URL or video ID)
4. Statement of good faith belief that use is unauthorized
5. Statement that information is accurate under penalty of perjury
6. Physical or electronic signature

5.4Trademarks

"BrevityU" and related logos are trademarks of Brevity Networks, LLC. Unauthorized use is prohibited. Respect others' trademarks and do not use them in ways that suggest endorsement.

6.1Moderation Approach

Current Moderation

• Human review of reported content
• Community reporting system
• Proactive monitoring of trending content

6.2Community Standards

• Be Respectful: Treat others with kindness and engage in constructive discussions
• Be Honest: Provide accurate information and cite sources when appropriate
• Be Educational: Share knowledge, help others learn, and promote scientific literacy
• Be Safe: Protect your privacy and others', and report harmful content

6.3Enforcement Actions

Warning

First-time or minor violations — educational notice about violation.

Content Removal

Content that violates Terms or Guidelines — removed without account penalty for first offense.

Temporary Suspension

Repeated or serious violations — duration: 7–30 days.

Permanent Ban

Severe violations (illegal content, child exploitation), or circumventing previous bans.

Legal Action

Illegal activities, threats to safety, or cooperation with law enforcement.

• Social Features: Follow users, like and comment on videos, receive notifications
• Discovery: Personalized feed, trending videos, search
• Profile Management: Customize profile, display educational interests

8.2Future Features

We may introduce: Advertising (display relevant ads), Premium Features (subscription-based), Live Streaming (real-time educational broadcasts), Collaboration Tools, and Advanced Analytics.

8.3Platform Availability

• We strive for 99.9% uptime
• Scheduled maintenance will be announced
• We do NOT guarantee uninterrupted access
• We are not liable for service interruptions

9.1Third-Party Services

• Cloudinary (Video Storage): Stores and delivers your videos — cloudinary.com/terms
• Analytics Providers: Help us understand platform usage

• We do NOT control or endorse third-party sites
• We are NOT responsible for their content or practices
• Accessing third-party sites is at your own risk
• Third-party terms and privacy policies apply

10.1Educational Platform Disclaimer

10.2"AS IS" and "AS AVAILABLE" Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

10.3Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREVITY NETWORKS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability shall not exceed the greater of: $100 USD, or amounts you paid to us in the 12 months before the claim.

10.4Jurisdictional Limitations

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability. In such jurisdictions, our liability is limited to the extent permitted by law.

11.1Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless Brevity Networks, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from:

• Your access to or use of BrevityU
• Your violation of these Terms
• Your violation of any law or regulation
• Content you upload or share
• Infringement of intellectual property rights
• Your interactions with other users

11.2Defense and Settlement

• We reserve the right to assume exclusive defense and control of any matter subject to indemnification
• You will cooperate with our defense of such claims
• You may not settle any claim without our prior written consent

12.1Termination by You

You may delete your account at any time: Go to Settings → Account Management → Delete Account. Confirm your decision twice; your account is disabled immediately and all PII is erased. A confirmation email with a 30-day recovery link is sent to your registered email address.

12.2Termination by Us

We may suspend or terminate your account immediately, without notice, for:

• Breach of these Terms
• Violation of Community Guidelines
• Illegal activities
• Harm to other users or the platform
• Prolonged inactivity (after notice)
• Legal requirements

12.3Survival

The following provisions survive termination: Intellectual Property (Section 5), Disclaimers and Limitations of Liability (Section 10), Indemnification (Section 11), Dispute Resolution (Section 13), Governing Law (Section 14), and General Provisions (Section 16).

13.1Informal Resolution

Before filing a claim, contact us at admin@brevityu.com to attempt informal resolution. Provide a detailed description of the dispute. We will respond within 30 days.

13.2Binding Arbitration

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under AAA's Consumer Arbitration Rules.

• Location: Virginia, United States (or mutually agreed location)
• Arbitrator's decision is final and binding
• We will pay AAA fees for claims under $10,000
• Each party pays their own attorneys' fees (unless awarded by arbitrator)

13.3Class Action Waiver

13.4Judicial Forum

If arbitration does not apply or is found unenforceable, exclusive jurisdiction is the state and federal courts in Virginia. You consent to personal jurisdiction in Virginia.

14.1Applicable Law

These Terms are governed by and construed in accordance with the Laws of the Commonwealth of Virginia and federal laws of the United States, without regard to conflict of law principles.

14.2Jurisdiction and Venue

• Exclusive Jurisdiction: State and federal courts located in Virginia
• You consent to personal jurisdiction in Virginia
• Any legal action must be brought in Virginia

14.3International Users

If you access BrevityU from outside the United States, you do so at your own initiative and are responsible for compliance with local laws. These Terms still govern your use.

15.1Right to Modify

We reserve the right to modify these Terms at any time for reasons including legal or regulatory requirements, new features or services, security enhancements, or business decisions.

15.2Notification of Changes

• Material Changes: Email notification, prominent in-app notification, 30-day notice
• Non-Material Changes: Updated "Last Updated" date, notification in app Settings

15.3Acceptance of Changes

Continued use after changes take effect constitutes acceptance. If you do not agree to changes, you must stop using the platform before changes take effect.

16.1Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Brevity Networks, LLC regarding the platform.

16.2Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and other provisions remain in full force and effect.

16.3Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision, or future enforcement thereof.

16.4Assignment

• You may NOT assign or transfer these Terms or your account — any attempted assignment is void
• We may assign these Terms to any affiliate or successor without your consent

16.5Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, government actions, internet failures, or public health emergencies.

16.6Language

These Terms are written in English. Any translations are for convenience only. In case of conflict, the English version prevails.
